Mrs Tabetha lives in a small village called Greyson, which is situated in KwaZulu-Natal. She has just received a telephone call from her daughter named Jenna, who resides in Abbey Wood, London. Mrs

Tabetha, who is 65 years old, has just found out that Jenna is pregnant with twins. Jenna has been

married for eight years and had been dealing with a lot of infertility issues in the past few years. Mrs

Tabetha is extremely excited and intends on visiting Jenna.

Mrs Tabetha applies for a passport at the Department of Home Affairs. Upon application for her passport,

she is informed, by an official, Mr Dube, at the Department of Home Affairs, that her application will take

about eight weeks in order for it to be processed.

After eight weeks, Mrs Tabetha receives a letter from the Department of Home Affairs informing her that

her application for a passport was unsuccessful. The letter is very vague and merely states that her

application for a passport has been rejected. The Department of Home Affairs does not provide any

reasons for their decision and they do not inform her of her right to request reasons.

1.1 Section 3 of PAJA deals with procedural fairness in respect of decisions affecting an individual. Will

the requirements of procedural fairness as outlined in section 3 of PAJA be applicable to the above
