where their classmates hang out. Each was texting pals to see who would be out and
Jerry, while distracted, ran a red light and entered an intersection where he another car
rammed him, seriously hurting Manuel.
Has Jerry committed a tort against his friend Manuel and be held liable for damages in
civil court? Why or why not? Be sure to apply the "test" for negligence or state why the
“presumption" of negligence applies if you believe Jerry is liable for Manuel's damages.
