rights are protected in civil court cases.

The seventh Amendment is first known as the preservation clause and it states ¨  In suites at common law , where the value in the controversy  shall be exceed twenty dollars , the right of trial by jury shall be preserved¨

So in conclusion I think it would be that police have a probable cause or either rights are protected.
