The Articles of Confederation was considered to be the first Constitution in the United States. They were created in 1777 but were ratified until 1781. Under the Articles of Confederation, the states were sovereign and independent and could collect taxes to have money. Congress could not, and when in need, Congress had to ask the states to get the money. Congress had a weak position. It just could operate a post office and oversees the relationships with Native American Indians.

Although the Articles of Confederation provided some stability during the War of Independence, it soon became clear what the weaknesses were. For example, according to the Articles, Congress had no powers to levy taxes, and Congress was dependent on money that the states transferred to the central government. Also, the Articles did not give the central government power over trade between states and there was not one person responsible for executive power but that power was in the hands of a committee of Congress.

Soon after the war the shortcomings became clear to everyone. In 1786, Charles Pinckney, a member of Congress, proposed to amend the Articles of Confederation to give the central government more powers to make the country's administration more efficient. This led in February 1787 to a convention between the states to debate changes to the Articles of Confederation. Eventually, the convention, which met in Philadelphia, led to a completely new instrument of governance, the United States Constitution, which replaced the Articles of Confederation in 1789.

The articles of the Confederation did not provide a judicial system to the United States. Similarly, Congress did not have the power to enforce the laws. The articles of the Confederation were not easy to modify because this required the unanimous vote in each state to do so. As the United States grew from 13 to 50 states, the articles would have been impossible to modify.
