A 4-year-old boy finds a loaded handgun, placed between the bed mattress and the box spring, which is not a safe place and shot his mother, who is eight months pregnant, in the face. The mom is now in hospital and hopefully in stable condition. The father is under investigation for not securing the gun, which he borrowed from a friend, and “putting somebody at risk”.
2) Is the father guilty or innocent? Defend him as his lawyer (5 arguments) or condemn him as a judge (5 arguments):
The father is guilty.
- He didn’t respect the law by borrowing his friend’s weapon, because if he borrows it is surely because he’s not allowed to own one.
- It is therefore the father who knew the place of the gun, which was not a safe place.
- The child is under the responsibility of his parents until he is 18 years old (he’s barely 4).
