Sarah Pen Industries, of Maryland, sold and shipped from its business offices, two freight containers of latex gloves to Medical Examiners, Inc., (Medical) a company based in West Virginia. When Medical failed to pay the $104,000 owed for the gloves, Sarah Penn sued in an Maryland court and obtained a judgment against Medical. Medical argued that it did not have minimum contracts with Maryland and therefore the Maryland judgment based on personal jurisdiction was invalid. Medical stated that it was incorporated under West Virginia law, had its principal place of business in West Virginia, did not have agents who entered Maryland, and therefore had no minimum contacts with Maryland. Was this statement alone sufficient to prevent the Maryland judgment from being collected against Medical in West Virginia? Why or why not?
