In 1926, Edward Steichen purchased "Bird in Space" by Constantin Brâncusi and tried to return to the US with the sculpture. New York customs declared that there was no import tax on art; however, the sculpture by Brancusi was not declared as "art", and categorized it domestic utensils and hospital supplies, taxing Steichen $200 in import costs. This was a significant moment in art history as the notions of aesthetics and art were challenged. Steichen challenged the judgement, and took the state to court.
